1 Ad Listing Requirements

Displaying the following in a listing whether in text, image or other forms, is prohibited.

  • Links to rival websites,
  • Links to websites that purchase, sell, or trade goods or services,
  • Links to websites that recommend trading other than Audiophile.org or aim to sell directly to the users of Audiophile.org,
  • Links to websites selling products prohibited on Audiophile.org, 
  • Links to websites demanding Audiophile.org user information and login credentials,
  • Listings promising the delivery of products not currently available to seller,
  • Listings suspicious of having the intention of price competition, unfair competition or slandering other products,
  • Listings always featuring text in capital letters,
  • Displaying a product marked as sold before the expiration date of its sale as if it has not been sold,
  • Deleting the contents of a listed product and then marking it as sold,
  • Displaying the same product in multiple categories,
  • Displaying suspected advertising and promotion or commercial content for multiple products into one listing,
  • Products and services included in “Appendix-4 Products and Services that are prohibited from listing or offering for sale”.

Identifying such entries will be at the website administrator’s discretion. Such entries may be removed by the website administration without prior warning, and the user may be banned from membership. In this case, the user may not claim a right or request a refund. 

Online shopping is based on effective safety. E-commerce, online stores and online shopping are all founded on this basic principle. The key element of security in e-commerce applications is mutual honesty, and Audiophile.org believes that all its users are trustworthy. Accurate and full communication is of utmost importance in selling and buying products. Please do not hesitate to contact the buyer/seller for any questions. 

Most the problems associated with online buying and selling on the Internet arise from misunderstandings. If you have any doubts regarding the content and accuracy of a listing, please inform the website administration about the said listing. We can correct the mistakes and even cancel the membership of the user following the examination we will carry out. The assessment will be performed by the audiophile.org portal administration, and no objection to this assessment may be made. 

2 Compliance with the Law

You are required to comply will all applicable local laws and regulations upon entering the site. Sales of illegal goods and services will not be allowed in this site, and not knowing the laws and regulations cannot be accepted as an excuse. Knowing which goods and services are illegal is the responsibility of the person that enters the listings.

3 Banning a User

In the event that Audiophile.org identifies a case it believes to be in violation of the laws or the website terms & conditions, Audiophile.org reserves the right to cancel the membership and top up credits of a user, and report that person to legal authorities without notice.

4 Accepting the Website Terms & Conditions

Audiophile.org provides online services including classified listings, discussion forums and email services (hereinafter referred to as “Service”) to all its users, and this service is subject to the following Terms & Conditions.
Audiophile.org may change or update these terms & conditions over time. By using any Audiophile.org service, you are deemed to have accepted and required to comply with all of these conditions. In addition, you are also deemed to have accepted the principles that are effective for an Audiophile.org service you are using but which may be changed over time. 
In the event that you object to these terms & conditions or the changes thereof in any way or if you are not satisfied with Audiophile.org for any reason, all you have to do is to stop using the services.

5 Content

The announcements, messages, texts, files, visuals, videos, audios and other material (“Content”) that are published, conveyed or connected to via the Service are deemed to belong to the person who had owned them before publishing.
In other words, you are deemed completely responsible for the full content and emails that you publish or submit via the Service since Audiophile.org only brings together the buyer and seller on this platform. 
Therefore, you are deemed to have accepted that the contents provided via our Service are not controlled by Audiophile.org, and Audiophile.org is not responsible for them, and that you may be exposed to disrespectful, offensive, rude, incorrect, misleading or disputable information or contents while using the Service.
The contents via Audiophile.org may provide links to other websites that are completely independent of Audiophile.org, and Audiophile.org does not guarantee the accuracy, integrity or authenticity of the information provided by those sites. The other websites that you link with are entirely your responsibility.
You are deemed to have accepted that you need to evaluate and undertake all related risks for a content, that you cannot trust a content, and that Audiophile.org cannot be held responsible for any content, or for damages and costs that may arise as a result of or due to using content that is provided via mail, email or related services.
You are also deemed to have accepted that Audiophile.org does not screen the contents or pass them through an approval mechanism, and that it reserves the right to refuse, delete or move those content without notice or solely with a warning or at its own discretion if its terms & conditions are violated.

6 Spam Mail Policy

Email ads that are prohibited or not consented for receipt cannot be sent via Audiophile.org’s computer and software systems. Acting to the contrary will be regarded as unauthorized use of Audiophile.org’s computer and software systems and a violation of the applicable Turkish laws and regulations, leading to criminal action against the infringing person or his/her representative.

7 Privacy and Disclosure of Data

The information and content to be listed on Audiophile.org is subject to the Privacy Policy, and explained under the Privacy and Intellectual Rights section. By using Audiophile.org and/or the Service, you are deemed to have read and accepted this Privacy Policy.

Furthermore, Audiophile.org may store, or hand over your content, email address, IP address and other information to legal authorities under the following conditions:

  • In the event of a violation of the law, or if warranted by a court order,
  • In the event that a third party claims that their rights have been violated,
  • In the event that the contact information of a third party is allegedly published or transferred without permission or as harassment,
  • In order to protect the rights, interests and personal security of Audiophile.org users or the public at large.
8 Intellectual Rights

The content on the site is protected to the maximum level permitted by copyright laws and international agreements. You are deemed to have accepted that you will not copy or duplicate the contents obtained from the services without written consent of Audiophile.org, and that you will comply with all copyright notices posted in the Service. You may not open, decompile, reverse engineer, or attempt to identify any source code contained in the Service. You are deemed to have accepted, without limiting the aforementioned, not to duplicate, copy, sell, resell or otherwise use any part of the Services for your own interests.
By posting on the Service’s publicly open section, the users of Audiophile.org are deemed to have automatically granted an irrevocable, continuous, non-proprietary, fully paid global license to Audiophile.org to use, copy, display, or distribute the said content, to work on it, and incorporate them into other works, and to grant sub-licenses related to the said issues. 
Furthermore, by posting the content in the publicly open section of the Service, the users are also deemed to have granted any party the right to use, display, copy, duplicate or utilize the content for their own interests on the Service for any reason.

9 Relations with institutions, persons and groups

Any relationship, including payments and deliveries related to goods/services you will purchase/sell from/to organizations and/or individuals on or via the service, is entirely between you and such organization and/or persons. Audiophile.org will not be held liable for any loss or damage arising from such relationships.
In case of a dispute between the participants or users and a third party, Audiophile.org is deemed to have no obligation to be involved. If you are in any dispute with one or more users, you agree that Audiophile.org officers, employees, representatives and heirs are indemnified from any claims, demands, compensations, damages and costs, whether arising out of or in connection with our services.

10 Execution

By logging into the website, you are deemed to have accepted that you will not publish the following types of content in any way whatsoever, not to send or submit them via email:

Any and all kinds of information, which is illegal, harmful, threatening, libelous, harassing, insulting, dishonorable, violating other individuals’ privacy, or hurting any person(s),

  • Showing a person having actual sexual intercourse (including but not limited with the following): (i) sexual intercourse, genital-genital, oral-genital, anal-genital or oral-anal, with persons of the same or the opposite sex, or (ii) conducting sexual acts with animals, or (iii) masturbation or (iv) showing S&M tendencies, or (v) showing the genital or private parts of any person provocatively.
  • To describe an individual or a specific group in a harassing, insulting, threatening and hateful way aiming their religion, language, physical disability, gender, sexual orientation, race, ethnicity, age or defects. 
  • All types of images, claims, texts and content of violence or related with violence.
  • Content that imitates any person, including (but not limited to) an Audiophile employee, or institution, or misrepresents your relationship with such person or institution (this provision is not applicable for messages that contain non-deceptive legal parodies of social forms).
  • Personal or descriptive information published about a person without his/her written consent.
  • Wrong, misleading, or deceptive information.
  • Content that infringes any party’s patent, trademark, trade secret, copyright or other intellectual property rights, or on which you do not have the right to comment under any law or agreement or fiduciary relation.
  • Content consisting of or including listings sent to Audiophile.org users who have not opted for “relationship marketing”, “junk mail”, “Spam”, “chain mails”, products or commercial benefits;
  • Content including links to commercial services or websites other than those permitted under “Services”.
  • Content promoting and/or selling illegal services or products, the sales of which are prohibited or restricted by law.
  • Content that contains software viruses, other computer codes, files or scripts designed to limit or damage the functionality of any computer software or hardware or telecommunication equipment.
  • Content suppressing the normal flow of dialog or negatively affecting the use of services by excessive messaging.
  • Content that includes wrong email addresses, which hide the origins of the information transmitted via the service, or fake page titles or manipulated descriptions.

In addition to the provisions above, you are also deemed to have accepted that you will not engage in the following acts:

  • Gathering personal information and data on other individuals for commercial or illegal purposes.
  • Using automation, bugs, bots, data search tools or similar tools clearly not permitted by Audiophile.org to download data from the service.
  • Uploading large data load to our infrastructure by publishing non-local or irrelevant content, republishing the same or similar content in unreasonable or inappropriate ways.
  • Publishing the same item or service in more than one classified category or forum, or in more than one key region.
  • Attempting to provide unpermitted access to the computer systems of Audiophile.org, or carrying out activities affecting the quality of the website Audiophile.org or damaging its functionality.
11 Restrictions on service

You are deemed to have accepted that Audiophile.org may restrict the use of the Service for technical or other reasons, such as content size, maximum number of days, maximum number of emails. You are deemed to have accepted that Audiophile.org is not responsible for deleting or interfering in any content transmitted or maintained by the Service.
Audiophile.org reserves the right to modify and terminate the Service (or any part thereof) with or without notice. Furthermore, Audiophile.org will not be held liable to a third party or to you for any changes to the Service, suspension or termination of the Service.

12 Access to Service

Audiophile.org provides its user with access to a restricted and non-exclusive Service for personal use. Without written permission of Audiophile.org, the content of any other user, or any part thereof, cannot be changed or uploaded. The right to personal use does not include collecting, accumulating, copying, displaying of content or information derived from the service, or data search, robots, bugs, or similar means of gathering data unless expressly specified by Audiophile.org.

General-purpose internet search engines and non-commercial open archives used to collect information for solely displaying the top links to the service are limited exceptions, and each one needs to use a fixed IP address or a serial IP address using an easily identifiable agent.

"General-purpose internet search engine" does not include a website or other services that are specialized in search engines or classified listings and sub-groups of classified listings such as home, business, sales, service, or personal listings, or are in the business of providing classified advertising services.

Audiophile.org allows you to create or display a parental link to the publications on the Service on your website, but such use is strictly forbidden from having commercial and/or news publishing purposes. You may create parental links to the home page of Audiophile.org sites provided that those links do not portray Audiophile.org employees or affiliates in biased, misleading, derogatory or offensive qualities.
Use of Service beyond the authorized access granted to you by Audiophile.org will immediately terminate this permission. You must purchase usage rights from Audiophile.org to use, aggregate, accumulate, and copy the content of the Service or provided by the Service for other (including commercial) purposes.

13 Termination of Services

Audiophile.org reserves the right at its own discretion to activate and deactivate your account, block your email or IP address, or terminate your access or use of the Services (or any part thereof) and change the content of the service for any reason in case it believes that you are not complying with the conditions specified.

In addition, you are deemed to have accepted that Audiophile.org will not be held liable to you or any third party for any reason whatsoever as to the termination of your access to the Services, and that you will not attempt to access the Services after such termination.

14 Waiver of Warranty

Your use of the Audiophile.org site and the Service is at your own risk. To the extent permitted by law, Audiophile.org disclaims all warranties regarding the security, reliability, accuracy, performance of the Audiophile.org Site and the Service.

It also disclaims any other service or product-related warranties, which are accessed through Audophile.org site or the Service, or accessed through the Service or the links on the Audiophile.org site, to the extent permitted by law. It also waives the warranties for viruses or other harmful components in connection with the Service or the Audiophile.org site to the extent permitted by law.

15 Limitation of Responsibilities

Audiophile.org will not be held responsible for any direct or indirect damages or losses arising from the use of the Service, whether caused by the use or misuse of the Audiophile.org site or the Service, or from the inability to use, disconnect, suspend, alter or terminate the Audiophile.org site or the Service.

This restriction also applies to damages arising from the information or suggestions published on or through the Audiophile.org site, the Service or the links, or the services or products obtained therefrom.

16 Indemnity

You are deemed to have accepted in advance that you will not hold the partners, officers, employees, affiliates, successors, representatives, executives, service providers, suppliers and personnel of third parties of Audiophile.org, for any loss or damage including applicable attorneys' fees and court costs, arising from your or the third parties' use of the service or the content you submit through the Service, violation of the conditions, violation of representation or warranties, or infringement of other rights, and cover your expenses.

17 Buying Selling Listing Rules

You can list your new and used devices for sale or barter on the website. Specific sections are paid, and other sections are free of charge but display is limited. 

You may enter only product information in the products section, and are not allowed to display information such as company introduction or promotion. 

If you are a professional seller, you may only introduce your company in the SELLERS section. You may promote your new products and campaigns in the news section. 

Please do not display your listings in a professional advertising style. Advertisements are subject to a fee on our website. Please write to info@audiophile.org for your questions and requests. 

Please comply with the codes of ethics in your copies and comments, and do not write anything that is offensive, hurtful or creating unfair competition. 

Content offered on our website is not controlled by us, but in the event of a complaint, messages that are disrespectful, aggressive, vulgar, misleading, violent or containing misleading unfair competition may be deleted without warning and the content owner’s access to the may be halted. 

The Audiophile.org website is responsible only for publishing the selling or buying listings to be displayed by the sellers or buyers, respectively, on the site, and should not be expected to know the buyer or seller. Buying and selling transactions sales are solely the responsibility of the buyer and the seller. Therefore, we recommend getting to know the other party well to protect yourself before you carry out any commercial transaction. 

You are required to mark your sold assets as sold in the membership information/my listings section instead of commenting that they have been sold. 

18 Relations with institutions, persons and groups
